GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter “GTCS”) apply without any restriction or reservation to all sales completed on the website orlinskishop.com, operated by OR FINE ART, a simplified joint stock company with share capital of €10,000, registered with the Paris Trade and Companies Register under number 891 848 482, whose registered office is located at 108 rue de Richelieu, 75002 Paris – France.

1. SCOPE

These GTCS govern sales of products between OR FINE ART and any non-trading natural person (hereinafter the “Customer”) placing an order on the website orlinskishop.com.
The Customer declares that they have read and accepted these GTCS before placing their order. Any order implies the Customer's full and unconditional acceptance of these GTCS.

2. PRODUCTS

The products offered for sale are those described on the website orlinskishop.com. OR FINE ART takes the utmost care in the presentation and description of these products to provide the Customer with the best possible information. However, errors or omissions may occur; OR FINE ART cannot be held liable in the event of a non-substantial error.

3. AVAILABILITY

Product offers are valid as long as they are visible on the site, subject to availability. Should a product be unavailable after the order has been confirmed, the Customer will be informed by email as soon as possible and may cancel the order or choose a substitution product.

4. PRICE

Prices are shown in euros including all taxes (VAT included), excluding delivery costs, which are specified before the order is confirmed.
OR FINE ART reserves the right to alter prices at any time. Products will be invoiced based on the prices applicable at the time the order is placed.

5. ORDERS

Placing an order on the website orlinskishop.com involves the following steps:
1. Selecting products
2. Adding them to the basket
3. Confirming the basket
4. Logging in to or creating a Customer account
5. Selecting a delivery method
6. Secure payment
7. Confirming the order by email
OR FINE ART reserves the right to reject any order for legitimate reasons (in particular in the event of a previous dispute, non-payment, or fraudulent behavior).

6. PAYMENT

Payment is made in full when placing the order, by bank card via a secure payment platform. Banking details are never stored by OR FINE ART.
The Customer warrants to OR FINE ART that they have the authorizations required to use the chosen payment method.

7. DELIVERY

Products are delivered to the delivery address provided by the Customer at the time of the order. Delivery times are specified during the order handling process.
In the event of late delivery, the Customer can contact customer service at editions@richardorlinski.com for information regarding order tracking.
In accordance with Article L216-1 of the French Consumer Code, if the indicative delivery time is exceeded by more than 30 days, the Customer may cancel the order by registered letter with acknowledgement of receipt and get a refund of the sums paid.

8. RIGHT OF CANCELLATION

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of cancellation without having to provide any reason or pay any penalties.
To exercise this right, the Customer must notify their decision in writing to the following address: contact@orlinskishop.com, specifying the references of the order.
The products must be returned in their original condition, complete and undamaged, to the address that will be provided. Return costs are to be borne by the Customer.
The refund will be made within 14 days of receipt of the products by OR FINE ART, using the same payment method as was used for the order.

Exceptions: In accordance with Article L221-28 of the French Consumer Code, the right of cancellation does not apply to personalized or made-to-order works.

9. COMPLAINTS – WARRANTIES

All products are provided with the legal warranties of conformity (Articles L217-3 et seq. of the French Consumer Code) and hidden defects (Articles 1641 et seq. of the French Civil Code).
In the event of a non-compliant or defective product, the Customer must send their complaint to: contact@orlinskishop.com, enclosing photos and a description of the defect.

10. LIABILITY

OR FINE ART cannot be held liable in the event of non-performance of the contract due to a case of force majeure, an unforeseeable or insurmountable event caused by a third party to the contract, or by the Customer.
OR FINE ART cannot be held liable for indirect damage.

11. PERSONAL DATA

The Customer’s personal data is collected and processed in accordance with the Privacy Policy available on the website.

12. INTELLECTUAL PROPERTY

All content on the site (texts, images, illustrations, logos, videos, etc.) is protected by copyright and intellectual property. Any reproduction, whether in whole or in part, is strictly prohibited without the prior written authorization of OR FINE ART.

13. APPLICABLE LAW – DISPUTES

These GTCS are governed by French law. In the event of a dispute, an amicable solution shall be sought as a priority. Failing this, French courts shall have exclusive jurisdiction.
